Pre-trial ruling in Shadwick v. SC DHEC et al

An Oconee Common Pleas judge issued pre-trial rulings last week in the case of a nurse practitioner who filed a complaint against three state agencies.  The civil case is Nataly Shadwick v. SC Attorney’s General Office, Tenth Circuit Solicitor’s Office, and SC Department of Health and Environmental Control.  Judge Lawton McIntosh directed a DHEC attorney to provide Shadwick’s lawyer copies of “all documents seized” while the plaintiff was under investigation for allegedly writing false prescriptions after her state registration allegedly expired.  According to Shadwick’s request for injunctive relief in December 2021, the plaintiff has not been charged with a crime and her property had not been returned, even after DHEC had more than 120 days to search the documents.  In a second part of McIntosh’s ruling, the judge denied the AG office’s motion to dismiss.
