No Matthew Durham trial April 17 week

 

The state will not go forward next month with prosecution of Matthew Durham, the Oconee County councilman suspended from office after his arrest last year on charges of unlawful neglect of a child and domestic violence second degree.  Lisa Burton, clerk of court, says her office was notified by the prosecution, the office of the South Carolina Attorney’s General, that it will not pursue the prosecution during the April 17 General Sessions Court week at Walhalla.  The charges against Durham had been listed number one for trial that week.  What’s not immediately clear is whether the AG’s office will call the case at another court term or whether it simply won’t go forward with prosecution at all.  Responding to a 101.7/WGOG NEWS inquiry March 22, AG spokesman Robert Kittle, to a question of whether his office will drop the charges or motion to drop them, said, “We can’t comment.  The defense can, but we cannot.” Today Kittle said, “The only information we can give is that the trial is not going forward in April.”  Durham has declined to make a public comment about this, and 101.7/WGOG NEWS received no response to a voice message left with his attorney.
