Lawsuit:  negligence allegations vs. Pickens Sheriff

A lawsuit alleging negligence against the Pickens County sheriff is laid out in a filing at the end of March in the Pickens County Court of Common Pleas.  The complaint is titled, Deborah Couch as the personal representative for the estate of Zane Kevin Marcus vs. Rick Clark, in his official capacity as Pickens County sheriff.  Plaintiff’s attorney is listed as Joseph Scibelli of Charlotte, North Carolina.  Marcus died September 1, 2021 when his motorcycle struck a tree that fallen at Crowe Creek Road and the Walhalla Highway.  The lawsuit alleges the sheriff’s office created a risk at that intersection by leaving the tree on Crowe Creek Road without limiting access to the road even though, according to the allegations, a deputy sheriff left the scene without erecting warning signals, such as flares and reflective triangles.  Plaintiff requests a jury award of actual and punitive damages, amount not specified in the complaint.
