Durham case –as yet, no decision to prosecute

If there is a decision to prosecute an Oconee County councilman, the decision apparently will be made by the state’s legal department.  Robert Kittle, spokesman for the Attorney’s General, confirmed today that the Matthew Durham case was referred to his office by David Wagner, the 10th Circuit Solicitor.  Wagner had previously said, to avoid a conflict, he would refer the matter for investigation outside the local circuit.  The AG’s Kittle said today, “We have assigned it (the complaint) to an attorney in our office to review.  No prosecutorial decision has been made yet.” Durham, first term councilman from District Two, has been the subject of a domestic abuse complaint.
