Court filing seeks to enforce consent order

DHEC has gone into the Oconee Common Pleas Court to ask a judge to require the holder of a composting facility permit near Seneca to abide by the provisions of a consent order that was executed nearly two and a half years ago.  The request for the enforcement action was undertaken by the state health agency which is obligated to enforce the state’s Solid Waste and Policy Management law.  It names New Century Construction defendant for New Century’s landfill on Davis Mill Road.  Under the permit, according to a DHEC attorney, New Century’s maximum storage is limited to 740 cubic yards of unprocessed wood material.  DHEC seeks for New Century to reduce the material to fewer than 740.74 cubic yards.
