State pursues enforcement action against landfill owner

South Carolina DHEC has gone into the Oconee Common Pleas Court seeking enforcement action against the owner of a private landfill, with whom it entered a consent order in June 2018. A DHEC attorney, Etta Williams Linen, wants DeWayne Pelfrey, owner of the White Land-Clearing Debris and Yard Trash Landfill near Seneca, to comply with the consent order and pay a $10 thousand fine. The landfill is located on Davis Mill Road. The DHEC attorney claims Pelfrey has not complied fully with a provision of the order that gave him 30 days to “have the property line surveyed and clearly marked; and, obtain a waiver from the adjacent property owner, if necessary; clearly mark the waste disposal boundaries; ensure that no waste piles are outside of the working face area; ensure the waste is spread in uniform layers; ensure that there is adequate cover on both active and inactive areas….”
