Seneca seeks dismissal of lawsuit

Seneca is asking the Common Pleas Court to throw out a lawsuit that names as defendant the police records department.  The plaintiff, Timothy Wayne Harmon, alleges he filed a Freedom of Information request for “all agency documents” related to an incident report, but was denied although he left a hand-delivered letter with the records division July 28.  The records department, through city attorney Michael Smith, filed a response to the civil complaint, saying Harmon was sent all documents, with the exception of three body-cam videos.  According to the answer, the videos were withheld so as to not interfere “with a prospective law enforcement proceeding.”  But, it said, Harmon was invited to watch the videos.
