Dismissal of challenge to Seneca utilities

REB Enterprises vs. The City of Seneca is a lawsuit no more.  Court records reveal dismissal documents spell out the dismissal of a civil lawsuit that pitted the developer of the Crossing Home development on the Bountyland Road against Seneca, a case in which the Crossing Home developer sought to obligate the city to reimburse for water and sewer materials for phase 3 of the development.  According to a stipulation of dismissal filed last month in the Common Pleas Court, the action is dismissed with prejudice, meaning the case has been ended and the plaintiff may not re-file the case on the same issue.  Each party in REB Enterprises v. Seneca must bear its own costs and attorney’s fees.
