Death from gun play focus of lawsuit

A youngster’s death from gun play at a Mountain Rest home last year is the subject of an Oconee County lawsuit alleging wrongful death and survival action.  The suit was filed this week in the Common Pleas Court on behalf of the estate of a child who, at the time, of  fatally being wounded was a visitor to the Mountain Rest home. Multiple individuals are named as defendants, and the pleadings allege they breached their duty of care by improperly storing a loaded pistol in the home. It further alleges that the child who later died and a minor friend were allowed to play with the loaded pistol outside the presence and in a separate room from any adults.
