State corrections motion denied
A 10th circuit judge will not allow the state Department of Corrections to be excused from an Oconee County lawsuit to decide whether there’s liability in the death in 2024 of a county inmate. Judge McIntosh ruled following a hearing this week that the DOC remain a defendant in a claim by Lisa McMahan, personal representative of the estate of Michael McMahan, the inmate who died after he was allegedly attacked by a fellow inmate. In the order to deny a motion to dismiss the DOC as a defendant, the judge wrote: “Plaintiff’s complaint has sufficient facts upon which relief could be granted. Therefore, defendant’s motion is dismissed.” Other defendant parties are the Oconee Sheriff’s Office, Sheriff Crenshaw, and the County of Oconee.
