Rep. Duncan part of a “friend of the Court” brief

Third District Representative Jeff Duncan, Laurens Republican, says he has joined a friend of the court brief urging the U-S Supreme Court to take up a case to delist Planned Parenthood as a South Carolina Medicaid provider.  The case, Kerr v. Edwards, centers on the state’s decision to delist Planned Parenthood.  The brief asks the court to take up the case, so as to overrule the 4th Circuit decision in favor of Planned Parenthood.  It argues that Congress intended for states to be able to make their own determinations as to what providers could participate in Medicaid and that clients of delisted providers should not have been granted standing to sue the state on the providers’ behalf.  Planned Parenthood says it delivers vital re-productive health care, sex education, and information to millions of people.  But Duncan says it masquerades as a “health care” group but is a pro-abortion activist group.
